Issues are discussed concerning the discoverability of applications for legal malpractice insurance and communication between a lawyer and insurer concerning a claim. Some states protect such information as part of the insurer-insured relationship, while to others it is merely communication regarding a contract.

Some problems that can emerge with third-party funds deposited in law firm trust accounts are described. Legal professional liability insurers may not cover bad check losses, so insisting on wired funds is always safer.
