The Independent Counsel statute: what went wrong?
Article Abstract:
The Ethics in Government Act of 1978, commonly called the Independent Counsel statute, is due to expire in 1999 unless Congress renews it. Analyzing the defects in the current statute could help in deciding whether to amend it or let it die. One clear defect is that the independent counsels whom the law authorizes are endowed with too much unchecked power. Another lesson is the value of insisting that independent counsels operate within bureaucratic constraints.

The irrelevance of constitutional amendments

The author contends that the importance of constitutional amendment process specified by Article V of the US Constitution has been exaggerated, and that fundamental changes to the constitutional order have occurred more often by precedents, rejected amendments such as the Equal Rights Act, and understandings that developed alongside the text of the Constitution.
