The cross-border insolvency paradigm: a defense of the modified universal approach considering the Japanese experience

The author examines five models of cross-border insolvency proceedings in relation to Japan's modified universal approach insolvency system. Systems employing universalism, modified universalism, secondary insolvency, corporate-charter contractualism, and territorialism are evaluated.
