The imperfect legacy: defects in the British legal system in colonial Hong Kong
Article Abstract:
There is concern that China will not live up to the commitments regarding freedom, capitalism and human rights expressed in the Sino-British Joint Declaration, but the legal system in place in colonial Hong Kong was not altogether successful in protecting these values. The British brought common law to Hong Kong during their rule, but many legal institutions and legal actors failed to uphold the civil liberties central to any common law system. The people of Hong Kong need to build on the colonial system, not merely maintain it, to realize the region's democratic potential.

Linkages in international investment regulation: the antinomies of the draft multilateral agreement on investment
Article Abstract:
The 1998 draft of the Multilateral Agreement on Investment (MAI) recommends a liberalization of regulations that affect international investments, but does not suggest specific structural arrangements for the linkages between investments and related policy issues. Clear standards need to be devised for specific industries and existing trade policies. The MAI committee was begun in 1995 under the auspices of the Organization for Economic Cooperation and Development, aimed to complete a draft in two years, but failed to produce a final draft by May 1998.
