Article Abstract:
The problem of the New York Legislature never having appropriated the funds to create the surrogate committees required by art 80 of the New York Mental Hygiene Law to oversee the medical treatment of incapacitated adults is discussed. The state's case law also holds that clear evidence of intent is required to withdraw life-sustaining treatment, impossible to obtain with a severely mentally disabled adult.
