The rules have changed - so proceed with caution: a comment on Engen and Gainey's method for modeling sentencing outcomes under guidelines
Article Abstract:
Criminologists Rodney Engen and Randy Gainey have discussed offense severity and prior records as nonlinear, nonadditive variables in determining sentencing lenth according to established guidelines. They offer an alternative method for measuring the influence of guidelines on sentencing: the actual presumptive sentence recommendation. Using Pennsylavania sentencing data the author discusses the limitations of Engen and Gainey's sentencing model.
