Some comments on contributory and induced patent infringement; implications for software developers
Article Abstract:
How software developers' marketing activities could make them guilty of induced or of contributory patent infringement is discussed. A court can find induced infringement when a developer's marketing activities encourage customers to use their products in infringing ways, and contributory infringement if their product is found to be a material part of an infringing process.

Judicial review of PTO patentability": determinations under the substantial evidence standard of review
Article Abstract:
The importance for the United States Court of Appeals for the Federal Circuit of using the "substantial evidence" standard when reviewing the Patent and Trademark Office's (PTO) factual findings is discussed. The Zurko and Gartside decisions are discussed as examples of this tendency to defer to PTO adjudications and let it regulate patentability issues.
