To handle the overload, create a national court
Article Abstract:
Federal and state judges should respond to court congestion by requesting that Congress create another set of national courts with jurisdiction over diversity cases and over state law cases involving parties from several states. Several regional courts of this kind would be in order. The growth in the criminal docket will continue to crowd out civil cases at both the state and federal levels and a new set of federal courts would be a much better way of managing congestion than the haphazard attempts which have been made thus far.

Splitting 9th Circuit needs more thought
Article Abstract:
Rather than push ahead with S 956 and split the 9th US Circuit Court of Appeals, Congress should establish a national study commission to evaluate the difficulties appellate courts are experiencing. Proponents of the split say a CA mentality dominates the present court and that it has grown too large and unwieldy, with a huge caseload generating inconsistent opinions. Splitting it would sacrifice economies of scale and other advantages, though, without examining other ways of improving efficiency.

Justice benefits from self-analysis
Article Abstract:
Attorneys and judges should not pay heed to critics of task forces and research efforts that study the problems of race, ethnicity, gender, and other points of difference in the justice system. These investigations have a distinguished history and have resulted in real changes in the process of administering justice, making it more just for all concerned. More than 40 court systems have commissioned such studies since the early 1980s.
