Attorneys specializing in computer law predict that Lotus v Paperback will result in the definitive ruling on copyright infringement of computer software. Lawyers in the case are trying again with a previously denied summary judgment motion based on a 2d Circuit ruling in Computer Associates v Altai. The judge in this case rejected a copyright infringement claim and disagreed with the holding in the Whelan case that all intellectual property not necessary for a software program's goal is protectable by copyright. He stated that this approach does not emphasize practical considerations enough.

Bills to overturn Pilot Life ruling are forging ahead
Article Abstract:
Two bills before Congress seek to reinstate employees' right to sue their employers' insurance providers in the state courts. HR 1602 and S 764 are in response to the Supreme Court's 1987 decision in Pilot Life Insurance Co v Dedeaux, which states that the Employee Retirement Income Security Act of 1974 prohibits state oversight of employee insurance plans. Plaintiffs' lawyers in recent cases claim the Pilot Life decision has left employees with no recourse in insurance matters. The industry has lobbied heavily against both bills.

Church, airlines balk at benefits law; San Francisco's domestic partners law causes big stir
Article Abstract:
San Francisco will be the first US city to have a domestic partnership ordinance when Ordinance 481-96 goes into effect on June 1, 1997, and the Catholic church and American Airlines have already objected to the ordinance. Catholic Archbishop William J. Levada has requested that church and religiously affiliated organizations be exempted from the ordinance, while United Airlines has delayed signing a new 25-year lease at San Francisco International Airport, saying lease approval should not be connected to that ordinance.
