Avista trustee Pattison knocks board colleagues

Avista board member William Pattison criticized the trustees of the real estate investment trust for not conducting an auction for the company. Pattison, who is also questioning the objectivity of Avista's financial advisers, is not in favor of the bid by Canadian Real Estate Investment Trust (CREIT) as he sees the offer by Summit to be more attractive. Avista's other trustees, on the other hand, supported CREIT's bis, which Pattison regarded as more risky.

The Ontario Securities Commission will have plenty of ammunition as it investigates the suspicious trading activity in the shares of Biovail Corp. A review of trading in Biovail's shares ahead of financial results for the first and second quarter in the 2003 also may suggest that some investors had inside knowledge that the company was about to release disappointing news.
