Microsoft returns to court hoping to find friendlier faces

Microsoft faces a more receptive environment once it returns to court to appeal Judge Thomas Penfield Jackson's ruling that it broke antitrust laws and should be split in two. The US Court of Appeals in Washington that will hear oral arguments from the software giant is made up of four Republican appointees and three Democratic appointees. Chief Judge Harry Edwards, a Democrat appointee, has adopted a cautious stance to competition enforcement, while three other judges have disqualified themselves.

Breakup may be no-go, but Microsoft isn't off the hook yet
Article Abstract:
The breakup of Microsoft now looms as a remote possibility after an appeals court said it will narrow the scope of the software giant's violations and will send the case to another judge for a more fitting penalty. Some of the earlier penalties imposed by Judge Thomas Penfield Jackson that may be retained include barring Microsoft from punishing PC makers that bundle non-Microsoft products into their PCs. Manufacturers would also be given the right to modify icons that first appear on the screen, which Microsoft has long controlled.
