Judge Says Maker Of OxyContin Misled Officials To Win Patents
Article Abstract:
Judge Sidney H. Stein of Federal District Court in Manhattan has ruled that Purdue Pharma deceived the Patent and Trademark Office to secure a patent for its painkilling drug OxyContin. Purdue had never done any clinical trials to support its claim that the painkiller provided relief with only a small dosage of 10 to 40 mg. The patent award delayed the launch of a generic version by Endo Pharmaceuticals which also sued the company. Stein's decision could pave the way for more lawsuits from state attorneys general and consumer groups who may contend that Purdue's deceit cost consumers billions of dollars because they could not obtain a cheaper version of the drug.

No Damages In Rosie Case, Judge Hints

New York State Supreme Court Justice Ira Gammerman rendered an immediate decision that gave no damages to Rosie magazine publisher and plaintiff Gruner and Jahr USA Publishing or Rosie O'Donnell, defendant, in their breach of contract lawsuit. He offered the opinion that all of the legal activity was nothing more than a showcase for bragging rights. He will provide a final ruling on other aspects of the case in a few weeks. It is generally believed that both parties hurt their reputations in a lawsuit the judge said was unwise for Gruner and Jahr USA to initiate.
