Mistrial Shows Risks in Choosing A Path for Prosecution

Credit Suisse First Boston investment banker Frank Quattrone survived the first round of his obstruction of justice trial after the judge declared a mistrial when the jury could not reach a decision. Prosecutors knew that they could not prove more serious charges of his participation in providing favored investors special allocations of stock offerings which were denied to less important clients. The prosecution team resorted to obstruction of justice charges based on an e-mail that Quattrone sent to employees to support management efforts to clear out potentially incriminating data files. Despite Quattrone's troublesome testimony, jurors still had problems supporting the prosecution case against him.

One of the problems of learning about accounting firms' earnings is underscored by the contrasts in reports from PricewaterhouseCoopers and Deloitte Touche Tohmatsu. The former reported $14.7 billion in revenue for the fiscal year ending June 30. Deloitte indicated it earned $15.1 billion by the end of May 31, but it added expenses billed to clients. PricewaterhouseCoopers said their figures would have been higher if they had not honored international accounting standards which it believes provide a more accurate reflection of its earnings.
