U.S. trademark court rules against Molson claim as oldest brewer

Molson Breweries' protest against the claims of Pennsylvania-based rival D.G. Yuengling & Son Inc. that it is America's oldest brewery has been refuted by the US Trademark Trial and Appeal Board. The court decision states that Montreal, Quebec-based Molson did not have enough proof to claim that the term "America" meant the entire North America and not the United States only. Molson uses the slogan "North America's oldest brewery" and contests that it is truly the oldest and not Yuengling. Molson claims that US consumers might get confused and not see the difference of the two claims. Molson will likely appeal the court decision, according to the company's VP of corporate affairs, Marylin McCrea. Molson started to brew beer in 1786, while Yuengling began to brew beer in 1829.
