Privatization and public employee pension rights: treading in unexplored territory
Article Abstract:
Public employees who have their positions privatized are in an uncertain position with regard to their pension rights. Since there is no public sector equivalent of ERISA, the rights of public employees who transfer to the private sector are not guaranteed. To resolve disputes, courts typically look to local and state statutes to resolve cases filed over pensions rights. One landmark ruling is the Supreme Court decision in the Inter-Modal case where the court ruled that the employer could not contract with a third party to reduce the benefits costs of people who were once public employees.
