Section 337 of the US Tariff Act and world trade law: compatible at last
Article Abstract:
An analysis of Section 337 of the US Tariff Act of 1930 and the subsequent complaints against the regulation in the World Trade Organization's dispute settlement body showed conclusively that the regulation is incompatible with the US obligations to the international trade organization. Section 337 excludes foreign suppliers from the US market if their products infringes on the intellectual property rights of US manufacturers. Cases brought against Section 337 have shown that the US contention that the regulation is about intellectual property rights is defeated by arguments showing that the regulation is meant to protect domestic industries.

The exhaustion of patent rights under WTO law
Article Abstract:
The international exhaustion of patent rights is not mandated under the Trade-Related Aspects of Intellectual Property Rights Agreement (TRIPS). Under the World Trade Organization (WTO) system, member states must reconcile their views on the exhaustion of patent rights based on policy rather on law. There is no existing prohibition which restricts member countries on their policy choice regarding patent rights. However, any new agreements on exhaustion of patent rights should be incorporated in the TRIPS Agreement.
