Holiday pay calculation should be based on calendar day
Article Abstract:
The UK Employment Appeals Tribunal's ruling in Thames Water Utilities v. Reynolds, held holiday pay owed to terminated employees must be calculated on a calendar day basis, rather than a working day basis. The decision effectively reduces the amount salaried employees are legally entitled to receive by allowing holiday pay to be calculated as annual salary divided by 365 days, rather than 260 working days. The EAT interpreted the Apportionment Act 1870 as applicable and requiring the calendar day method of calculation.
