Article Abstract:
There are a number of complex legal issues relating to estate agents' commission. Among these, the matter of an estate agent's 'sole selling rights' was addressed in the case of Christie Owen & Davis plc v King 1998. In this case, the judges expressed the view that any notice determining the agency agreement was invalid unless sent by recorded delivery. The court ruled in favour of the plaintiff estate agents, finding that the agents were entitled to the agreed commission because the property was purchased by two men who had received details about it from the plaintiffs.

Article Abstract:
An estate agent, in the UK, who fails to give, according to their competency, a true value of a piece of land or passes on untrue information to a buyer will be considered as acting fraudulently. Estate agents could be found guilty under the Theft Act 1968 if they buy a property for less than its true value. They will also be found guilty under the Prevention of Corruption Act 1906 if they keep any gifts which may later be seen as a bribe. In both situations the estate agent may face a prison sentence.

Agent's appeal court win highlights Act anomalies
Article Abstract:
The recent appeal court victory of Castles Estate Agents in a case against Enfield Borough Council indicates that estate agents are not obliged to check information provided by a house seller unless they have any reasons to be suspicious. This case highlights anomalies relating to the 1991 Property Misdescriptions Act, and the National Association of Estate Agents is now calling for the Act to be reviewed.
