A seller or a seller's agent has a duty to disclose material physical facts affecting the value of a home. Homebuyers, however, in most states, lack legal authority to compel homeowners to disclose psychological facts affecting the value of the property, such as the murder of previous occupants or annoying neighbors. This means prospective home buyers have an affirmative duty to investigate such facts on their own. State disclosure laws and cases are discussed and tips for home buyers are given.

In some jurisdictions, taxes are a form of waste
Article Abstract:
State and federal courts have begun to recognize unpaid property taxes as a form of waste when litigating claims brought by mortgagees against mortgagers. Waste has traditionally meant anything that undermines the long term value of a property. In both cases, mortgagees claimed that, because the unpaid taxes on a piece of property caused the value of the outstanding debt to eclipse the value of the property and its tax liability, waste had occured.

Eminent domain is not what it used to be
Article Abstract:
The author reviews several cases from various states in which eminent domain takings were challenged. He uses these cases to make conclusions about the way courts now view eminent domain of which parties in such cases should be aware.
