Church Commissioners for England v Ibrahim and another
Article Abstract:
A United Kingdom Court of Appeal hearing on February 9 1996 upheld the appeal of the Church Commissioners for England against a decision made in another court considering the recovery of rent arrears from tenants. The landlords had sought an order for recovery of costs on an indemnity basis, but the recorder had decided against such an order. The appeal hearing ruled that the landlords were entitled to costs on an indemnity basis under the terms of the tenancy agreement.
