Tough ruling hits home
Article Abstract:
The UK Court of Appeal decided a tenant's objective intention was the most important factor in a case of statutory protection for a residential tenant. The UK Rents Acts and Housing Acts of 1995 and 1998 confer statutory protection on the main home of a tenant. Initially the courts decided the tenant had left his home and had made the subjective intention to return. The Court of Appeal disagreed pointing out the tenant had sub-let his home and had made no attempt to resolve the problems which had caused him to leave in the first place.

Little change was noted in the direction of court proceedings for legal issues concerning property and valuation in the United Kingdom during 1995. A memorable case involved the over-valuation of a property which resulted in an unnecessary mortgage loan to have been taken out. The valuer was seen as negligent, and had to pay all costs and any losses to the lender and vendor.
