Commission structures for leasing representatives

Leasing representatives provide office space and retail space for their clients and are paid with low base salaries but additional commission payments based upon the revenue they earn for their leasing firm. Leasing professionals who provide tenant representation services are compensated by a commission that is derived from a percentage of the leasing commission's revenue. Leasing professionals who provide product leasing services are compensated by a decent base salary plus an incentive based upon leased space plus dollars earned.

Information intended to help arbitrators understand real estate disputes arising from "additional rent" issues is presented. Escalation clauses fall into two basic categories: clauses intended to compensate landlords for higher operating costs and property taxes, and those intended, in addition, to counter the effects of inflation. Arbitrators can find guidance in the large body of case law that exists in relation to escalation clauses.

The "SPS": a new way to calculate operating expense pass-throughs
Article Abstract:
Separate pro rata share calculations can be used instead of the gross-up provision calculations when determining the variable and fixed expenses of commercial leases. These pass-through expenses are calculated in order to protect landlord and tenant when an office building is not fully occupied during the term of the lease. The differences in these two calculations can determine whether the gross-up calculations are reasonable.
