Planning authorities in the UK have the right to grant planning permission subject to conditions under section 70 of the Town and Country Planning Act 1990. Under section 78 of this Act, there is a right to appeal against these conditions. Property developers considering making an appeal should be aware that the Secretary of State for the Environment, Transport and the Regions has the right to consider the principle of whether the development should be allowed, not just the condition itself. It is also unclear what may be taken into account in the determination of an application to extend a time limit.

A streamlined appeal framework
Article Abstract:
The UK government issued a consultation paper in Jan 1997 which outlines planned changes to the development plans and appeals processes. This paper suggests that some disputes may be resolved through mediation, thus eliminating the need to use the appeals process. It recommends that a panel of mediators is used for small neighbour disputes and in larger cases to reduce the scope of a public inquiry. Some observers feel that the proposed changes will not really make significant improvements to the development plan system and appeals process.

United Kingdom Secretary of State for the Environment (SOS) John Prescott is able to intervene in planning procedures if it is considered that an application has implications for regional or countrywide policies. The 'call in' of planning applications is included in the 1990 Town and Country Planning Act. There is some uncertainty to what extent Prescott will use his powers. Local authorities are encouraged to view planning applications within the wider development plans issued by the SOS.
