Article Abstract:
It is important to consider the legal aspects of underletting a property at less than the price allowed in the lease by using a side letter limiting the undertenant's actual liability to the amount of the market rent. It is best to avoid the temptation to not inform the landlord about the side letter, as the landlord has the right to know the terms of the proposed underlease for which consent is sought. If the side letter is not revealed, then the landlord's consent may prove to be invalid. If consent is withheld, then action can be taken under the Landlord and Tenant Act 1988.

Leasehold reform presents a political problem for the UK government, according to government-funded leaseholder advisory service LEASE Chmn the Earl of Lytton. In particular, there is conflict over the issue of marriage value, the merged value of the freehold and the lease. He believes that LEASE is able to offer advice about how to deal with the existing situation, even though it cannot offer a very significant change in the way tenure is organized. He is more in favour of gradual change than of tenure revolution.
