Guidance in permissions
Article Abstract:
The UK government has recently issued Circular 11/95, which updates Circular 1/85 - The Use of Conditions in Planning Permissions. Conditions play an important role in the development control process, and can present many problems for developers, especially as courts begin to take a stricter line on work undertaken in breach of a condition. The new guidance contains new categories of model conditions, which include staff accommodation, aerodromes, contaminated land and amenity land.

Sounding some early warnings
Article Abstract:
A number of recent cases have raised important issues relating to planning law. These include two relating to the operation of section 54A of the Town and Country Planning Act 1990, dealing with issues including the authority of a decision letter from a local planning authority inspector. In another case, the main issue was tree preservation orders, dealing with whether trees should be designated as 'woodland.'
