Innocent landowner loses big
Article Abstract:
A recent study on commercial real estate transactions indicated that up to 80% of the transactions could not qualify for a 'innocent landowner purchaser' defense under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). It was estimated that some 805 transactions were held potentially liable under the CERCLA. Brokers, landowners and developers should carefully consider the implications of CERCLA in their transactions.
