A new lease should include exact details of contamination already present and the outcome of any contamination caused by leasers. Landlords can indicate conditions of a lease concerning use of land and require an environmental audit. Developers will need to find full information concerning contamination levels of a site and detail remedies before making an application for planning permission. Expert negotiators may have a role in cases of land contamination.

Building a motorway service area (MSA), in the UK, entails some special planning requirements particularly concerning the siting of storage tanks, landscaping, the placement of acoustic barriers and suitable parking facilities. MSAs often have several small units offering a variety of restaurants and retail outlets. The main tenant will be the fuel operator. A MSA must provide specified amenities for the public, such as petrol, free parking and toilet facilities. The owner of the site must keep the blue motorway signs in good repair. The MSAs were deregulated in Aug 1992.

It is anticipated the new provisions dealing with contaminated land, which have been brought in as part of the Uk Environmental Act 1995, will be explained fully in a document to be published at the start of 2000. Contamination of land must be on, in or under the ground. There must be a receptor and a pathway to the contaminant. The substance causing the contamination must be harmful or either pollute or could pollute water. The local authorities have a responsibility to survey the land and issue remediation notices to the people considered to have liability.
