Two recent cases have highlighted the importance for UK landlords of dealing with requests for permission to sublet very quickly and in full detail. Care must also be taken to give detailed reasons for refusal of consent to sublet in writing. If the landlord intends to suspend the timetable for dealing with a request for permission to sublet, then a request must be made in writing. If the tenant does not agree or fails to respond quickly, then the landlord is on notice that he must continue to deal with the application.

Supermarkets and other retailers may be subject to keep open clauses in shopping centres, and they are relieved at the House of Lords' judgment in Co-op Insurance Society Ltd v Argyll Stores (Holdings) Ltd (1997) 23 EG 141. Tenants would prefer not to have a covenant but they can use it to argue for discounts on rent reviews. The case is reviewed with details of the main reasons why specific performance would not usually be granted if it could force a tenant to continue business.

Issues are presented concerning the legal provisions under the Landlord and Tenant (Covenants) Act 1995 which exist for the establishment of personal covenants between landlords and tenants. The application of statutory releases is discussed.
