Plan-led swan song?

The UK's development plan-led system faces an uncertain future. The Court of Appeal decision in Welsh Development Agency v Carmarthenshire County Council is encouraging a return to planning by appeal. It confirms that the final decision must be made in the appellate system, and thus limits the significance of the local plan process.

Circulars referring to new planning legislation for 1997 have been issued by the United Kingdom Government. The circulars deal with questions of planning obligations and sensitive issues such as permitting house-building in the open country. Statements such as allowing individuals to develop their own land, unless there are sufficient environmental reasons against such actions, may lead to difficulties for planning officers. Some of the suggestions in the circulars are unclear but local planning offices can ignore the circulars if they are in conflict with local issues.

Out of control
Article Abstract:
A case brought against a branch of Tesco PLC found it was not in conflict with planning regulations when it opened a pharmacy outlet within one of its stores. Tesco had gained permission to open a supermarket in Essex, England. The UK Court of Appeal overturned a previous conviction for unsanctioned work on a Grade II listed building in Essex. A planning inspector was accused of not acting in accordance of section 54a of the Town and Courty Planning Act 1990. The judge agreed with the plaintiff, the inspector had failed to specify if his actions were in accordance with local plans.
