The plaintiffs in the case bought the building and the mortgage lender commissioned a low-cost valuation survey. The defendants pointed out that a more detailed survey would be preferable. They were seen as negligent and appealed against the decision, and the appeal was dismissed at the UK Court of Appeal.

Esselte AB and another v Pearl Assurance plc
Article Abstract:
A legal case involving relations between a landlord and tenant related to abandonment of occupancy prior to the expiry of the agreed period. The tenant, Pearl Assurance, argued that they had ended their occupation so should not have to pay rent. The legal decision was that the tenancy was under the protection of 1954 legislation, the Landlord and Tenant Act, and the tenancy continued unless it was ended in line with provisions stipulated under that act.
