The Americans with Disabilities Act: concerns for lenders, owners, and tenants
Article Abstract:
The Americans with Disablilites Act of 1990 (ADA) provides equal opportunities for the handicapped in all areas. Title III, which deals with requirements for public places and commercial facilities, is of particular concern to the real estate industry. A summary of the ADA's major requirements for new construction, renovations and existing facilities, as well as compliance and contractural responsibilities, are provided. Since the responsibilities for ADA compliance with respect to existing facilities are not clearly defined, both owners and tenants should independently draw up compliance plans.

Article Abstract:
Regulation X relates to the United States Real Estate Settlement Procedures Act, interpreting the Act and, together with the Housing and Community Development Act, bringing about important revisions. Those involved in mortgage transactions now have to be more open about charges and involvement with parties taking part in transactions. These changes mean a major overhaul in procedures, practices and products for mortgage brokers and others involved in property finance.
