Valuing the borrower
Article Abstract:
The actual time a lender suffers a loss, due the actions of a valuer, must be identified. The courts will need to decide when interest should start if an award for damages is made. There is also a limit of six years in which a claim must be started. A case concerning negligence was heard in the UK House of Lords, during 1998. The decision by the Lords has led to some confusion on which date should be used and how it can be identified. The Lords included the concept of the borrower's covenant.

Article Abstract:
Legal break notices came under review in the UK courts in 1998, when legal establishments were asked to decide the correct meaning in respect to tenants. Law reforms appear to have come down mainly on the side of tenants in 1998, although repair cases have tended to favour landlords. Changes have also been made to the use of expert witnesses in court cases, which is expected to reflect on future valuation figures.
