Will two recent Supreme Court cases have a carryover effect on the sexual harassment of tenants?
Article Abstract:
Two Supreme Court cases toughened the standard for sexual harassment in the workplace which, if applied to sexual harassment of tenants by managers, could also toughen the standard for landlords. In Faragher v. City of Boca Raton and Burlington Industries v. Ellerth, the Court ruled that employers could be held strictly liable for harassment by supervisors. This ruling may herald the day when the negligence standard now applicable to landlords is changed to strict liability.
