Commission v. Council: some reflections on criminal law in the first pillar
Article Abstract:
Issues of criminal law competence within the EC as well as of accountability and legitimacy between the European Union and Member States are discussed. The focus is on the Commission v. Council case, which highlights the problem of delimitation of competencies between the first and third pillars.
