Public interest immunity (PII) implies the inclusion or exclusion of evidence in court proceedings. It applies differently in civil and criminal cases. The Matrix Churchill case was based on Lord Justice Bingham's 1989 judgment on the Makanjuola case. Ministers asked to sign a certificate of PII have to exercise discretion. In the Matrix Churchill case, ministers could have provided a statement advising the judge of additional factors. They should have thought about the special circumstances before deciding to sign.

Trevor Dakin, a former British prisoner of war of the Japanese who died on Apr 15, 1998, was determined to persuade the Japanese to make a formal apology for their behaviour. He returned to Kanchanaburi, Thailand, to live in 1987, and felt he was doing something constructive by relating his story to as many people as possible. He even befriended Nagase Takashi, the former torturer of Eric Lomax, and the two had planned to undertake a lecture tour to inform schoolchildren about the Death Railway.

Brave man who refused to be scapegoat
Article Abstract:
Paul Henderson supplied MI6 with information about Saddam Hussein's weapons procurement yet was arrested in Oct 1990, accused of deceiving the government. Secret documents proved his innocence. They established that it had been government policy to aid Iraq's munitions industry. Ministers Kenneth Clarke Tristan Garel-Jones, Michael Heseltine and Malcolm Rifkind attempted to withhold these documents to safeguard national interest, leaving Mr Henderson to go to prison.
