"Haves" versus "have nots" in state supreme courts: allocating docket space and wins in power asymmetric cases
Article Abstract:
The authors seek to determine how much docket space is allotted by state courts to civil cases involving conflicts between privileged and disadvantaged litigants. They also investigate the question of how often the disadvantaged win such litigation. The basis for the inquiry is an examination of state supreme court cases decided in 1996.

The roles of retribution and utility in determining punishment
Article Abstract:
The motives that drive people to inflict punishment on others and the psychological justification used by them to explain their behavior later are explored. Retribution and utility are two broad justifications for the use of punishment, which is a common and inescapable aspect of daily life.

The article discusses the results of a four-state survey of residents aware of important state criminal laws. It is concluded that greater efforts to educate the public about such laws are needed.
