Mistake or murder?

The trial of a doctor at Redbud Community Hospital in Lakeport, CA, for second-degree murder in connection with the death of a baby raises important issues regarding law and ethics in medicine. The accused, Dr Wolfgang Schug, was charged by the baby's parents for allegedly underestimating the baby's condition and failing to take appropriate measures to treat him. The case has generated a debate over whether the law should be used to change physicians' attitudes and whether Schug has committed murder or just a plain mistake.

Withholding care: a test case
Article Abstract:
Two cases wherein physicians willfully violated medical laws are discussed. Physicians should always follow steps that ensure the health of their patients. Any physician who refuses to treat or follow the orders of a patient or the patients' appropriate surrogate can be liable for violating health laws. However, physicians have the option to refuse to give patients treatment when patients themselves or their immediate family requested the order.

Genetics and confidentiality
Article Abstract:
Several states observe laws that keep HMOs and other insurers from using genetic information as a basis for giving coverage and setting rates. These laws, which have been credited for maintaining confidentiality and keeping health costs low, indicate that genetic information is personal property. The laws, however, have stemmed the profits of insurance companies as well as progress in the field of DNA research.
