1984 Sony case key to Napster legal strategy

The attorneys shaping Napster Inc.'s copyright case are relying on a 1984 US Supreme Court decision allowing Sony Corp. to continue producing its Betamax VCR, ruling that a new technology that could be used for piracy could be allowed provided it also could be used for legal 'substantial noninfringing uses.' Napster is scheduled for an Oct. 2, 2000 hearing before the U.S. Court of Appeals for the Ninth Circuit in San Francisco, CA.

Napster, fighting for survival, to make case before appeals panel

Napster Inc. will appear before the Court of Appeals for the 9th Circuit where the company hopes to make available unauthorized music on its swapping service. Russell J. Frackman is representing the sound recording industry in the copyright infringement case against Napster. Though many are betting against Napster's chances, some think the company has an argument under the 1998 Digital Millennium Copyright Act.

Judge sharply criticizes Napster's effort to block copyrighted music on its site
Article Abstract:
U.S. District Court Judge Marilyn Hall Patel is angry at Napster for hundreds of song titles that are still available on its computers. The online music site has failed to block copyrighted material from being downloaded. Judge Patel appointed A.J. Nichols to mediate between Napster and the sound recording industry. Napster continues its legal argument involving a Sony Betamax ruling from the Supreme Court in 1984 on copyright infringement.
