AUSTRIA: LIABILITY IN ACCIDENTS
Article Abstract:
According to Austria's railway and motor vehicle liability law (EKHG), the operator of the means of transport is liable to pay compensations of up to Sch 4mn or an annual pension of Sch 240,000 per person to those who were injured or died as a result of a traffic accident in cases where the operator can prove that he was not at fault. In other cases, those injured or their relatives may claim higher damages. At least 159 people lost their lives in a fire of a ground funicular in a tunnel in Kaprun on 11 November 2000. Generali is the responsible insurance company.
