Industry attacks EU's draft comparative advertising law
Article Abstract:
The Council of Ministers is to implement new laws concerning comparative advertising, prohibiting the use of unfair comparisons. However the proposed law has caused confusion and there are claims that it fails to clarify the rules in each country. The proposed directive bans member states from imposing tighter restrictions on comparative advertising than those in the directive, but another article allows member states to set their own restrictions on advertising.

Article Abstract:
The Federal Court of Justice, Karlsruhe, Germany, has upheld a ban on three Benetton poster advertisements. The court's decision reaffirmed a previous ruling that the ads in question infringed competition law on the grounds that Benetton was using animal and human suffering for financial gain. The ads which have been banned include one featuring a human body stamped HIV positive, a child worker in Latin America, and a duck in an oil slick.
