'Don Simon' ataca a Danone con publicidad cmparativa
Article Abstract:
Spanish fruit juice and wine producer Bodegas Garcia Carrion has invested Pta 300mn in a comparative TV commercial in which it compares its Don Simon brand juice line with the Minute Maid Premium brand which belongs to Danone of France and Coca Cola Foods. The commercial just began airing on August 1st and Danone is said to be so negatively surprised by the ad it could take legal action against the Spanish company. Garcia Carrion alleges, however, that what the commercial is about can be demonstrated: that Danone's juice is based on concentrate, while Garcia Carrion's is fresh juice. Comparative advertising is legal in Spain since 1988 although there is an unwritten pact that it not really be used.
