Antitrust policy: a century of economic and legal thinking
Article Abstract:
The Sherman Act of 1890 gave great power to federal judges to control monopoly power. The act is unique in its broad provisions and usage of common law for implementing those provisions. US antitrust statutes have evolved over time, and economists have influenced policy and competition law. Economists have both argued the case for competition, and have helped to develop policy. Law schools rely on economic theory, while economists have joined antitrust agencies.
