How to reduce risk of disputes

In the JCT 80 Standard Form of Contract, the Invitation to Tender, NSC/T Part 1, and the documentation relating to it are important in minimising the likelihood of disputes arising between main contractors and electrical sub-contractors. The Invitation to Tender received by sub-contractors is completed by the architect and includes information on both the main contract and the sub-contract. An important element in the sub-contract information relates to the attendance items to be provided free of charge by the main contractor to the sub-contractor since this is often a factor in building disputes.

Sub-contractors wishing to be nominated for specialist work under the terms of Amendment 10 to JCT 80 need to complete the eight-page NSC/T Part 2 tender form. Electrical contractors are advised to ensure that there are no discrepancies between the completed Invitation to Tender NSC/T Part 1 and the completed NSC/T Part 2 since such discrepancies are a cause of disputes. Sub-contractors are required to complete five items on the tender form regarding their performance. The information to be supplied in these five items is described.

A vital initiative for reform
Article Abstract:
The Electrical Contractors' Assocaition has published forms of contract and tender for specialist contractors. The forms intend to reduce conflict, ensure financial security to all parties and to allow a range of methods of procurement, including contracts for design work. A system of guaranteed, monthly payments is intended to provide security of payment for the contractor. The forms also encourage the use of mediation rather than arbitration in the case of disputes.
