Providers likely to face more, longer antitrust probes

Mergers of physicians' practices and other healthcare providers may expect closer scrutiny by antitrust enforcers, according to speakers at the 1995 American Bar Assn's annual meeting. A device called 'subsequent review' allows investigations by the Federal Trade Commission and/or the Dept of Justice to extend over longer periods of time. Marshfield Clinic, in Wisconsin, will appeal a decision that the group attempted to prevent Blue Cross from setting up a managed-care health maintenance organization.

Two steps forward, one back: key tort reforms advance in Senate; damage cap stalls
Article Abstract:
The Senate has voted in favor of several major professional liability tort reforms, but it declined to consider a noneconomic-damages cap, the reform proposal considered most important by the medical community. The accepted reforms were amended to a products liability bill. American Medical Assn leaders, pleased with the passage of the reforms, have vowed to continue fighting for the damages cap.
