States ripe for tort reform: more coalitions, GOP legislatures helping the cause
Article Abstract:
Physicians in many states are hopeful that the new Republican majority in their state legislatures will aid them in achieving tort reform measures, such as those in effect in California. These measures include a cap on noneconomic damages, a rule to allow payment of large settlements over several years, and a sliding-scale limit on lawyers' contingency fees. Physicians are forming coalitions to promote tort reform, and report much progress, even in states where there has previously been serious opposition.

Lawyers, consumers vow tort reform fight
Article Abstract:
Lawyers' groups and consumer groups disagree on tort reform and may engage in extensive lobbying efforts to support their views. Medical groups object to White House health care reformers' initial plan, which would holds hospitals accountable for the actions of physicians. Several different plans are now being considered, including reforms enacted in California in 1975. These include caps on lawyers' fees and the periodic payment of awards. An analysis of the debate over tort reform is also presented.

Tort reform proponents want losers to pay legal costs
Article Abstract:
Alaw that would require losing plaintiffs to pay court costs has been proposed in California. Some doctors believe the law would discourage the filing of frivolous malpractice suits. However, others believe judges might then direct losing defendants to pay plaintiffs' legal fees also. Proponents of the bill claim it would protect other possible targets such as municipalities or little league teams that fear being sued. The California Medical Assn does not support the proposal.
