Reasonable adjustment duty may require transfer to another job
Article Abstract:
The House of Lords has ruled that a disabled person should be treated favorably than a non-disabled person, which could mean transferring an employee to a suitable position. The ruling in the Archibald v Fife Council (1 July 2004) is presented. MS Archibald, working as a sweeper in Fife Council was dismissed from service after she developed a disability and could not go through the redeployment procedure successfully.
