Article Abstract:
The Supreme Court ruling that capital punishment violates the cruel and unusual punishment clause is discussed. The court ruled, however, that there was insufficient evidence of a national consensus to warrant ending capital punishment for all mentally retarded people.

A sense of normalcy; advocates for the mentally disabled say the ADA may require their care outside large facilities
Article Abstract:
Using the Americans with Disabilities Act (ADA) to support treating the mentally handicapped in group homes rather than large institutions is the issue in one of the ADA cases to reach the US Supreme Court in the 1998-99 term. Justice Department regulations interpreting the act require that public institutions provide services in the most integrated setting suitable to disabled peoples' needs. The case is Olmstead v. L.C. and E.W.
