Allstate faces new liability; judge finds anti-lawyer claims policy constitutes the unauthorized practice of law

The ruling by a Washington Superior Court in Jones v. Allstate Insurance Co. is discussed, and the court ruled that the insurance company's policy of discouraging claimants from hiring lawyers amounted to the unauthorized practice of law.The issue was Allstate's policy of handling personal injury claims stemming from automobile accidents.

Lawyers across the US find that Allstate Insurance litigates aggressively, even with small cases. Some plaintiffs' lawyers accuse the insurance company of such litigation whenever plaintiffs hire attorneys. Several attorneys interviewed claim to have discovered internal correspondence during discovery proving an intent to keep claimants from hiring lawyers, in order to pay out smaller claims. Allstate's Claim Core Process Redesign, started in Jan 1995, was, according to plaintiffs' filings, designed to discourage plaintiffs' claims in 150 markets across the country.

Hot CLE class: hammering Allstate; trial lawyers in many states, irked over its tactics, target insurer

A continuing legal education (CLE) class offered by the Connectict Trial Lawyers Ass'n and picked up by other states, one on how to sue Allstate Corp, is described. CLE seminars on this topic have been very popular because Allstate's habit of forcing trial with low settlement offers has made lawyers angry.
