Choosing the trustee of a charitable remainder trust
Article Abstract:
Several significant issues should guide the decision of whether to appoint the grantor or an independent party as trustee of a charitable remainder trust (CRT). The trust could become taxable and lose charitable deductions if, for example, a grantor-beneficiary is named trustee with powers to affect the enjoyment of income distribution among beneficiaries. A unitrust holding assets not readily subject to valuation should at least have an independent trustee authorized to value the assets.

Comparing the advantages of estates and revocable trusts
Article Abstract:
Revocable trusts may offer estate tax advantages in some situations and should be considered in estate planning, but most clients would gain no more benefits than they receive through the use of a living will. People who should consider living trusts are those who own businesses and want to ensure quick continuity, are worried about being incapacitated in the future, or who have real estate in multiple states. The benefits and drawbacks are such trusts are discussed.

Favorable tax and estate planning law in Delaware should be examined by persons or their planning professionals in other states for possible advantages. Delaware's relatively liberal trust and tax laws include advantages such as the allowance of perpetual personal trusts.
