Article Abstract:
The author of the 1994 book 'The Death of Common Sense: How Law is Suffocating America' now spends a third of his time working with government officials who want to put his ideas into practice. Philip K Howard, a lawyer at NY's Howard, Darby & Levin, does corporate and appellate work rather than government law, which he thinks lends him credibility. He argues that in the 1960s the legal system overrode common sense, leading to voluminous regulations rather than simple, plain-language goals and devaluing the law.

Prosecutors' plan to bypass counsel fans corporate ire
Article Abstract:
The US Department of Justice has received much adverse comment on proposed rules giving federal law enforcement officials authority to bypass corporate counsel in conducting investigatory interviews with corporate employees. The American Corporate Counsel Assn views with concern the proposed denial of legal advice to corporate employees involved in ex parte communications, while federal prosecutors say they need to be able to talk secretly with people within a potentially criminal operation.

Reuniting the EPA's watchdogs; but the enforcers may be on a tighter leash
Article Abstract:
The Clinton administration EPA under Carol Browner hopes to stress cooperation rather than punishment in its attempts to prevent pollution. This approach would be another change after a Reagan administration which neglected environmental enforcement entirely and a Bush administration which emphasized the technicalities of enforcement more than substance. An internal task force has advised Browner on the need for more voluntary compliance and for streamlining regulations.
